Consent laws in Colorado – What is Consent?

Definition of Consent – Colorado Revised Statute § 18-3-401
(1.5) “Consent” for sexual activity means cooperation in act or attitude pursuant to an exercise of free will and with knowledge of the nature of the act. A current or previous relationship shall not be sufficient to constitute consent. Submission under the influence of fear shall not constitute consent.

Safe Haven

The Safe Haven Law allows a parent to legally surrender a newborn baby to a fire station or hospital within 72 hours of birth.  Provided the baby is unharmed, there are no questions asked and it remains confidential.

Good Samaritan Law

The 911 Good Samaritan Law states that  a person is immune from criminal prosecution for an offense when the person reports, in good faith, an emergency drug or alcohol overdose even to a law enforcement officer, to the 911 system, or to a medical provider. This same immunity applies to persons who remain at the scene of the event until a law enforcement officer or an emergency medical responder arrives, or if the person remains at the facilities of the medical provider until a law enforcement officer, emergency medical responder, or medical provider arrives. The immunity described above also extends to the person who suffered the emergency drug or alcohol overdose event. There are limitations to immunity based upon possession and/or distribution of certain amounts of substances.

Third party Naloxone

This law allows for a person other than a health care provider or health care facility who acts in good faith to administer naloxone to another person whom the person believes to be suffering an opiate-related drug overdose. The individual who administers naloxone shall be immune from criminal prosecution for such an act. Amended July 13, 2020, to extend immunity to individuals administering expired naloxone.

In the U.S., any sexual content involving someone under 18 is illegal and is considered child sexual abuse material (CSAM), once called child pornography. So exchanging sexts with someone under 18 can certainly put you at risk of facing consequences. This is true even if you are both under 18.

U.S. federal law states that a minor cannot legally give consent to be in these types of images or videos – regardless of state ages of consent. This also means that a minor who takes sexually explicit photos or videos of themself can be charged with the crime of self-generated child sexual abuse material (SG-CSAM).

The penalties for having or sharing such images or video may include:

  • Fines or community service

  • Counseling

  • Probation

  • Youth detention or adult incarceration (depending on your age)

  • Sex offender registration – state and federal listings of individual convicted of sexual offense
